(Cavan-Monaghan) asked the Minister for the Public Service if an order has recently been made under section 5 (1) of the Civil Service Commissioners Act, 1956 excluding for the purposes of that Act, certain positions in the Departments of Justice and Health; and if so, why this order was made and how it is proposed to fill the excluded positions.

I assume the Deputy's question relates to a number of orders made by the Civil Service Commissioners, particulars of which were published in Iris Oifigiúil of 9 January 1979. Two of the orders, which relate to the Department of Justice, were to enable immediate offers of temporary employment to be made to some successful candidates at Civil Service Commission competitions for prison officer (trades) and welfare officer, pending the completion of formalities for their permanent appointment. A further order for the Department of Justice was made to enable a female prison officer to continue to be employed in an unestablished capacity. An order for the Department of Health was made to continue the employment in a temporary capacity of an officer who was under consideration for appointment to a permanent post of clerical assistant in that Department.
