Vol. 314 No. 11

Suspension of Member.

The Leas-Cheann Comhairle reports to me that Deputy L'Estrange has refused to obey the ruling of the Chair and I must name the Deputy.

(Cavan-Monaghan): On a point of order, this incident arose just before the Dáil was suspended but——

The Chair is not concerned about going into it now. The Leas-Cheann Comhairle has reported and I must act.

(Cavan-Monaghan): Will the Ceann Comhairle tell the House exactly what the disobedience was, because it was not too clear?

The Leas-Cheann Comhairle reported to me that the Deputy refused to leave the House when he was asked to do so. Will the Minister for Justice propose that Deputy L'Estrange be suspended from the service of the House?

I move: "That Deputy L'Estrange be suspended from the service of the Dáil."

I wish to raise a point of order in the context of the Bill we are discussing which is related to the application——

I hope Deputies are not trying to defend disorder in the House.

I am trying to establish a principle here, and it is time it was established, in the context of a Bill dealing with the failure to apply the principle of natural justice in another case. I see a situation here where one of my colleagues is named without having any opportunity to defend himself or to hear the charge on which he is——

Deputy O'Keeffe, this is not a case where speeches may be made.

I am raising——

When the Ceann Comhairle takes over the Chair he must act on the report of the Leas-Cheann Comhairle, which clearly indicates that a Deputy refused to obey his ruling and defied it. I have asked the Minister to name Deputy L'Estrange.

Can I complete my point of order?

Deputy L'Estrange is suspended from the service of the House. I would ask Deputy L'Estrange to leave the House now.

I wish to inform you, Sir, that I have no intention of leaving the House because what I have said is true.

The Deputy will respect the House and please leave quietly.

I will not, Sir. I have no intention of leaving. I think it is a disgrace what has happened in the Garda Síochána.

Then the sitting of the House is suspended for ten minutes.

Business suspended at 6.15 p.m. and resumed at 6.25 p.m.
