Vol. 318 No. 2

Written Answers. - Court Awards.

384.

asked the Minister for Justice if he has satisfied himself with the present position regarding judgments by the courts in respect of overdue sums, in particular the inability of a court to award interest to the successful plaintiff in many cases, if he considers that this situation encourages companies and individuals to defer such payments, and if he will introduce legislation to end this anomaly.

I would refer the Deputy to my reply to a previous question on 21 June 1979 in which I indicated that I hoped to introduce legislation on the subject of interest on judgement debts as soon as possible. I also indicated that it was quite likely that the subject would be dealt with in conjunction with other matters and I can now confirm that this is in fact what I propose. The legislative proposals as a whole will be somewhat complex but I hope to be in a position to have a Bill circulated within the next few months. This will take into account the recommendations in the 10th Interim Report of the Committee on Court Practice and Procedure regarding the interest payable on judgment debts.
