asked the Minister for Energy the operative date of the amended regulation affecting "failure of health" in Article 3, of the Bord na Móna superannuation scheme, 1978, in relation to an employee who wished to appeal against the refusal of the management of the board to pay the appropriate superannuation benefit, arising from his inability to continue at his normal job, and if he will outline his policy in relation to the provision of an effective appeals system similar to other superannuation schemes.

The operative date of the amended regulation affecting "failure of health" in paragraph 3 (b) of the Turf Development Act, 1953 (Regular Works Employees) Superannuation (Amendment) Scheme, 1978 is as set out in paragraph 5 of the said scheme, that is, 4 June 1970.

I am not aware that the appeals system provided for in the Turf Development Act, 1953 (Regular Works Employees) Superannuation Scheme 1963, as amended, is not effective nor have I received any proposals from Bord na Móna for amendment of the system. The relevant provisions regarding an appeals system are generally in line with those obtaining in superannuation schemes elsewhere in the public sector.
