asked the Minister for Social Welfare the reason unemployment assistance was not paid to a person (details supplied) in County Roscommon; and if he will ensure that it will be paid immediately.

The unemployment assistance claim of the person concerned was disallowed by a deciding officer of my Department on the grounds that his means, derived from the value of capital and from the beneficial occupation of land exceeded the statutory limit. The person concerned did not appeal against the assessment of his means although he was advised of his right to do so.

asked the Minister for Social Welfare if he is aware of the case of a person (details supplied) in County Waterford, who was insurably employed up to 1978 and who now has no income from his Department; and if he will make a statement on the matter.

According to my Department's records the person concerned was in receipt of disability benefit from 1977 to 29 December 1980, when he attained the age of 66 years and he was eligible to claim an old age pension. Although he was advised to claim an old age pension on approaching pension age he did not do so. Accordingly it is in his interest to apply for pension without delay. An application form may be obtained at any post office.

asked the Minister for Social Welfare whether a person (details supplied) in County Waterford has received all unemployment, pay-related and other social welfare benefits due to him; and if he will make a statement on the matter.

There is no record of the receipt of a claim for unemployment benefit in my Department from the person concerned. He did, however, claim disability benefit from 13 November 1981 and was paid from 17 November 1981, fourth day of incapacity, at the maximum appropriate rate. All disability benefit due to 9 February 1982, after which date he was certified fit to resume work, has been issued.

The social welfare regulations provide that the combined weekly rate of disability benefit and pay-related benefit may not exceed a person's reckonable earnings in the tax year relevant to his claim. As the weekly flat rate of disability benefit (£55.10) payable in this case was greater than the reckonable weekly earnings (£50.48) in 1979-80, the tax year relevant to his claim, the claimant is precluded from receiving payment of pay-related benefit.
