Written Answers. - Social Welfare Benefits.

asked the Minister for Social Welfare when social welfare benefit will be paid to a person (details supplied) in County Cork.

It has not been possible from the information supplied to trace a benefit claim for the person concerned. If the RSI number or the social insurance number of the claimant can be quoted this will enable the claim to be identified and the information sought by the Deputy to be supplied.

113.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Cork.

The person concerned was assessed with nil means and his unemployment assistance claim was allowed at the maximum rate payable to him £25.45 weekly and all arrears due were paid to him on 28 April 1983.

Further weekly payments continue to be made as they become due.

114.

asked the Minister for Social Welfare when social welfare benefit will be paid to a person (details supplied) in County Cork.

The person concerned received his maximum entitlement of 390 days' unemployment benefit, following which he applied for unemployment assistance. On the completion of inquiries his application was authorised at the appropriate maximum weekly rate in his case of £25.45. All arrears due were issued to him on 29 March 1983 and weekly payments of £25.45 continue to be made as they become due.

asked the Minister for Social Welfare when unemployment benefit will be paid to a person (details supplied) in County Cork.

The person concerned is employed for two days each week as a mart worker and exhausted his title to unemployment benefit on 29 October 1982 when he received 390 days of benefit. He will not requalify for benefit until he obtains a further 13 weeks of insurable employment with contributions paid at a class which provide cover against unemployment.

He claimed unemployment assistance and following an investigation of his case means were assessed at £12.50 weekly derived from the value of his land. He is accordingly entitled to unemployment assistance at the weekly rate of £45.45 being the maximum rate payable to him £57.95 less £12.50. All arrears of unemployment assistance due in respect of four days of unemployment each week were paid to him on 24 March 1983. Further payments at the daily rate of £7.58 continue to be made as they become due.

116.

asked the Minister for Social Welfare the reason disability benefit was reduced in the case of a person (details supplied) in County Cork.

The person concerned has been paid flat-rate disability benefit at the maximum rate appropriate to a married man from 22 March 1983, fourth day of incapacity to 13 May 1983, the date of the latest medical certificate received.

Pay-related benefit was also in payment at the weekly rate of £20.60 from 1 April 1983, thirteenth day of incapacity to 2 April 1983 based on his average reckonable weekly earnings in 1981-82, the relevant income tax year governing his claim.

Arising from the provisions of the Social Welfare Act, 1983, the amount of pay-related benefit was reduced to £12.87 per week from 4 April 1983 and his overall payment is now £65.02 per week. A letter explaining the variation in payment was issued to the person concerned at the time of the change.

asked the Minister for Social Welfare when unemployment benefit will be paid to a person (details supplied) in County Cork.

The person concerned claimed occupational injury benefit on 4 January 1983 in respect of an incapacity resulting from an accident at work on 17 December 1982.

Pending the completion of investigations resulting from the accident, his entitlement to disability benefit on an interim basis was examined. On the record available he did not however satisfy the qualifying contribution conditions.

Inquiries made from the employers revealed that the injuries concerned arose as a result of an incident at the place of employment which required to be investigated by an outdoor officer before a decision could be made.

Following investigation, injury benefit was awarded from 17 December 1982, the date of the accident. All injury benefit together with pay-related benefit which was awarded from 31 December 1982, the thirteenth day of incapacity, has now been paid to date.

118.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Cork.

The person concerned is not entitled to unemployment assistance as the weekly means assessed against him, £28.85, exceed the maximum rate payable to him, £25.45 weekly. Means in his case are derived from land.

He appealed against the amount of means assessed against him but an appeals officer upheld the decision assessing means at £28.85 weekly.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Cork.

The person concerned is a postal applicant for unemployment assistance and an order for encashment at his local post office paying all arrears due was issued to him on 3 May 1983.

Further weekly payments at £21.75, being the maximum rate payable to him, £25.45 less £3.70 means, derived from the value of capital, will be made as they become due.

120.

asked the Minister for Social Welfare when social welfare benefit will be paid to a person (details supplied) in County Cork.

The person concerned claimed old age contributory pension in November 1982. Since he will not reach pension age until January 1984 his claim was treated as a claim for retirement pension.

One of the conditions for receipt of retirement pension in the case of the person concerned is that he must have a yearly average of at least 24 contributions over the period from the beginning of the 1962 contribution year, the year he entered into insurance, to 5 April 1982. His total of 443 contributions in this period gives him a yearly average of 22. He does not therefore qualify for retirement pension.

The decision that he does not qualify for retirement pension has been upheld by an appeals officer whose decision in the matter is final, unless new evidence which was not previously available comes to light.

When he reaches 66 years of age the person concerned will, however, qualify for old age contributory pension for which the minimum yearly average is 20 contributions. He is advised therefore to submit a claim for this pension at the end of October 1983.

asked the Minister for Social Welfare the reason social welfare benefit was reduced in the case of a person (details supplied) in County Cork.

The person concerned claimed disability benefit from 18 May 1981 and payment at the maximum rate was issued to 1 January 1983. Payment of benefit after that date depended on her 1981-82 insurance record which showed 46 reckonable contributions. A minimum of 48 is necessary for maximum entitlement.

It was subsequently established however that the person concerned was entitled to further credited contributions and thus qualified her for maximum rate benefit from 3 January.

Her contribution record has been amended accordingly and arrears of benefit for the period from 3 January 1983 have been issued.

122.

asked the Minister for Social Welfare the reason social welfare benefit at the full rate was not paid to a person (details supplied) in County Cork.

The person concerned was paid disability benefit at the maximum rate appropriate to a married couple with one child dependant from 4 February 1983, fourth day of incapacity to 9 April 1983, after which date he was certified fit to resume work.

He was also paid pay-related benefit from 15 February 1983, thirteenth day of incapacity to 9 April 1983. There was a delay in the issue of pay-related benefit while the claimant's earnings in the relevant income tax year were being established.

123.

asked the Minister for Social Welfare the reason unemployment benefit was not paid to a person (details supplied) in County Cork when he was out of work from 13 November to 1 December 1981.

The person concerned claimed unemployment benefit on 14 November 1981 but his claim was disallowed as he did not satisfy the contribution condition of having at least 26 weeks of insurable employment prior to the onset of his claim.

His entitlement to unemployment assistance was then considered and his case was referred to a social welfare officer for investigation of his means. However, he was not available for interview when called on by the social welfare officer and his claim was disallowed. He did not appeal against the disallowance and he ceased to sign as unemployed after 1 December 1981.

The person concerned claimed unemployment assistance on 11 April 1983 and his case was referred to a social welfare officer for investigation of his means. Inquiries are still being made with a view to determining these and when the inquiries have been completed entitlement to unemployment assistance will be decided.
