asked the Minister for Labour when an appeal against unfair dismissal by a person (details supplied) in County Kilkenny will be acknowledged by his Department.

I understand that the employee in this case submitted a claim under the Unfair Dismissals Act, 1977, for investigation by a rights commissioner on 7 June 1983. He was informed by letter on 17 June 1983 that, as he had only five months' continuous service with his previous employer, he would not be in a position to pursue a claim under the Unfair Dismissals Act, which applies only to employees who, at the date of their dismissal, have had at least one year's continuous service with their employers. It was suggested to the employee, however, that his case might be appropriate for investigation by a rights commissioner under the Industrial Relations Act, 1969. The procedure for referring a case for investigation under that Act was outlined. To date, no claim under the Industrial Relations Act, 1969, has been received by the rights commissioner service.
