asked the Minister for Justice whether consideration has been given to the State becoming a party to the Hague Convention on the recognition of divorce and legal separations; and if he will make a statement on the matter.

Limerick East): The Law Reform Commission in their working paper entitled “Domicile and Habitual Residence as connecting factors in the conflict of laws”, said that The Hague Convention on the Recognition of Divorces and Legal Separations raised many questions for resolution before Ireland could adhere to it and that the task of analysing the implications of the convention as a whole and of considering the respective merits of the alternative policies that it embraces was one that involved extended research and deliberation. It is proposed to defer consideration of the convention at least until after the publication of the commission's working paper on the subject. As the working paper has not yet been published I do not think there is anything more helpful that can be said on the subject at present.
