Written Answers. - Social Welfare Benefits.

asked the Minister for Social Welfare the reason pay-related benefit is not being paid to a person (details supplied) in County Cork as he claims he should have been paid from 1 January 1984.

The person concerned applied for unemployment assistance on 12 August 1982 and all payment due to him was made. He did not qualify for unemployment benefit then because he had no reckonable contributions in the governing contribution year 6 April 1980 to 5 April 1981.

In order to determine his entitlement to unemployment benefit from the commencement of the new benefit year on 3 January 1983, he was requested on numerous occasions to furnish his local employment office with details of his employment and contributions paid during the contribution year 6 April 1981 to 5 April 1982. This information was supplied only recently and he has qualified for unemployment benefit from 3 January 1983. His claim has been authorised at £56.30 weekly increasing to £61.95 from 30 June 1983 and at £56.95 from 29 August 1983.

An adjusting payment as between unemployment assistance paid and unemployment benefit due for the period 3 January 1983 to 24 January 1984, amounting to £177.97 has been issued to him by way of a payable order for encashment at his local post office on 27 January 1984. Further payments of unemployment benefit at the weekly rate of £56.95 will continue as they become due.

He is not entitled to any payment of pay-related benefit because his flat-rate unemployment benefit exceeds the 85 per cent limit of £51.36 weekly applicable in his case.

asked the Minister for Social Welfare when unemployment benefit will be paid to a person (details supplied) in County Cork.

The person concerned did not satisfy the contribution conditions for unemployment benefit from the commencement of his claim on 3 October 1983.

However, a new benefit year commenced on 2 January 1984 and following the completion of inquiries it was established that he fulfilled the contribution condition for the maximum rate of unemployment benefit payable to him £65.60 from that date.

Arrangements have been made to pay all arrears due this week and further weekly payments will be made as they become due.

262.

(Limerick West) asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Limerick.

Following an investigation of his means by a social welfare officer the unemployment assistance claim of the person concerned was disallowed on the grounds that his means derived from land exceeded the statutory limit. He has appealed against the disallowance and his case has been referred to a social welfare officer for additional inquiries. When these are completed his case will be submitted to an appeals officer for determination and his entitlement to unemployment assistance will be reviewed in the light of the decision of the appeals officer.

(Limerick West) asked the Minister for Social Welfare when an increased rate of unemployment assistance will be paid to a person (details supplied) in County Limerick.

The person concerned was assessed with means at £38.45 weekly derived from self-employment as a carpenter. He is at present in receipt of unemployment assistance at £59.80 weekly being the maximum weekly rate payable to him £98.25 less £38.45. If he is dissatisfied with the amount of means assessed against him it is open to him to appeal and to have his means determined by an appeals officer. A form for this purpose may be obtained at his local office.

asked the Minister for Social Welfare the reason unemployment assistance at the maximum rate has not been granted to a person (details supplied) in County Roscommon.

The person concerned is at present in receipt of unemployment assistance at £2.40 weekly, being the maximum rate payable to him £28.00 less means £25.60. Means in his case are derived from the value of board and lodging on his mother's holding. He recently appealed at his local office against the means assessment and arrangements are being made to submit his case to an appeals officer for determination.

asked the Minister for Social Welfare the reason unemployment assistance was withdrawn in the case of a person (details supplied) in County Roscommon as he has no income whatsoever.

The unemployment assistance claim of the person concerned was disallowed on the grounds that by failing to furnish details of his means he failed to show his means did not exceed the statutory limit. He appealed against the decision and furnished the required information to the social welfare officer during a further investigation. His means have now been assessed at £8.65 weekly derived from land. He is accordingly entitled to payment of unemployment assistance at the rate of £20.75 weekly, being the maximum rate £29.40 less £8.65 and arrangements have been made to pay all arrears due to him on 2 February 1984. Further payments will be made as they become due.

asked the Minister for Social Welfare the reason unemployment assistance was withdrawn from a person (details supplied) in County Roscommon.

Following an investigation of his case by a social welfare officer the unemployment assistance claim of the person concerned was disallowed from 18 January 1984 on the grounds that his means £29.70 weekly derived from capital and from land exceeded the maximum rate of unemployment assistance payable to him. If he is dissatisfied with the amount of means assessed against him it is open to him to appeal and to have his case determined by an appeals officer. A form for this purpose may be obtained at his local office.

asked the Minister for Social Welfare the reason unemployment assistance is not being paid to a person (details supplied) in County Kerry.

Following re-investigation of his means by a social welfare officer the unemployment assistance claim of the person concerned was disallowed from 11 January 1984 on the grounds that his means, derived from land exceeded the statutory limit. He indicated that he wished to appeal against the disallowance of unemployment assistance and was given the appropriate form on which to set out the grounds of his appeal. On receipt of the completed form arrangements will be made to submit his case to an appeals officer for determination.

asked the Minister for Social Welfare if an invalidity pension will be paid to a person (details supplied) in County Wexford.

The person concerned has been in receipt of disability benefit since 22 January 1982 and payment is being made at regular weekly intervals. Invalidity pension is payable in place of disability benefit to insured persons who satisfy the contribution conditions and who are permanently incapable of work. In this connection, arrangements are being made to have him examined by a medical referee on 9 February 1984. His entitlement to invalidity pension will be reviewed in the light of the report of this examination.

asked the Minister for Social Welfare if disability benefit will be paid to a person (details supplied) in County Wexford.

There is no record in my Department of a claim for disability benefit having been received from the person concerned in April 1983. He did, however, claim disability benefit from 11 January 1984 and all benefit payable from 14 January 1984 to 24 January 1984, the date of the latest medical certificate received, has been issued. The claimant had been paid unemployment benefit to 13 January 1984.
