asked the Minister for Social Welfare when free electricity will be granted to a person (details supplied) in County Donegal.

One of the conditions for receipt of a free electricity allowance is that the applicant must be living alone or if living with another person the latter must be an excepted person for the purpose of the scheme.

The person concerned is living with her son who is not an excepted person. The son is in receipt of unemployment assistance on the basis that he is available for full-time employment. He is not for this reason an excepted person for the purposes of the free electricity scheme and the person concerned does not satisfy the conditions for receipt of an allowance for this person.

503.

asked the Minister for Social Welfare the reason unemployment benefit has not been paid to a person (details supplied) in County Mayo.

Availability for work is a condition of entitlement to unemployment benefit and to fulfil this condition an applicant must be capable of, available for and genuinely seeking work. The person concerned claimed unemployment benefit on 28 October 1983 and her claim was disallowed on the grounds that she was not available for work. She appealed against the disallowance of her claim and attended an oral hearing of her case which took place on 23 February 1984. The appeals officer also decided that she was not available for work. She last signed as unemployed on 24 February 1984 and has not been in touch with her local office since that date.

asked the Minister for Social Welfare if unemployment assistance will be paid to a person (details supplied) in County Cork.

The person concerned was issued with a number of application forms in order to claim unemployment assistance. He finally returned a completed application on 8 March 1984. His case was then referred to a social welfare officer for investigation of his means. It is expected, however that the officer will complete his inquiries shortly, after which his means will be assessed and his entitlement to unemployment assistance determined accordingly.

asked the Minister for Social Welfare if maternity benefit will be paid to a person (details supplied) in County Cork.

All maternity benefit due to the person concerned was issued on 15 March 1984.

506.

asked the Minister for Social Welfare if he will expedite payment of disability benefit arrears to a person (details supplied) in County Roscommon.

Payment of disability benefit to the person concerned, who has been in receipt of this benefit since September 1981, has been interrupted on a number of occasions recently due to the non-receipt of medical evidence at the proper time.

He has been requested on several occasions to submit medical certification on a regular basis while he remains incapable of work and a further reminder was issued to him on 23 March 1984. All benefit due to date has been issued.

asked the Minister for Social Welfare the reason for the delay in having an adjusted widow's non-contributory pension returned to a person (details supplied) in County Waterford.

One of the conditions for the receipt of widow's non-contributory pension by a widow under 66 years of age with two qualified children is that her means do not exceed £62 per week. The means of the person concerned derived from a holding of land and a small amount of capital were assessed at £93.93 per week and her reapplication for pension was accordingly refused. She was informed of this on 5 July 1983.

In view of the Deputy's representations, however, the local social welfare officer has been requested to furnish an up-to-date report on the claimant's circumstances, to allow her entitlement to pension to be re-examined. When this report is received a further decision will be given in the case and the claimant will be notified of the outcome.

508.

asked the Minister for Social Welfare if a non-contributory old age pension will be paid to a person (details supplied) in County Wexford.

The old age pension of the person concerned has been partially investigated by the social welfare officer. Details of five bank accounts have been requested and when these are received, the claim will be referred to the local pension committee for decision. If payment of pension is recommended by the social welfare officer, it will be put into payment on a provisional basis pending the committee's decision.

(Limerick West) asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Limerick.

The person concerned is being paid disability benefit at the weekly rate of £34.80, the maximum rate payable to a single man. All disability benefit due to 20 March 1984, the date of the latest medical certificate received, has been issued.

asked the Minister for Social Welfare when a contributory old age pension will be paid to a person (details supplied) in County Donegal.

The old age pension claim of the person concerned has been investigated and forwarded to the local pension committee for decision. Payment of pension at the maximum rate of £38.60 has been recommended by the social welfare officer with effect from 28 November 1983. The appropriate pension book payable from 20 January 1984 has been issued on a provisional basis pending the committee's decision and a payable order covering the arrears due in respect of the period 28 November 1983 to 13 January 1984 has issued separately.

asked the Minister for Social Welfare when an old age pension will be granted to a person (details supplied) in County Kerry.

The person concerned is currently in receipt of an old age non-contributory pension at the weekly rate of £20.60. A claim for an increase in her pension has been investigated and referred to an appeals officer for decision as the local pension committee are not functioning. As soon as the appeals officer has given his decision the person concerned will be notified.

asked the Minister for Social Welfare when an invalidity pension book will be issued to a person (details supplied) in County Kerry; and if he will make a statement on the matter.

The person concerned has been claiming disability benefit since 27 January 1984. Disability benefit is being paid to him at the rate of £34.80 a week, the maximum rate appropriate to an unmarried man. The regulations governing entitlement to invalidity pension provide that the claimant, apart from satisfying the contribution conditions, must be regarded as permanently incapable of work, in order to qualify for invalidity pension.

A claimant is regarded as permanently incapable of work if he has been incapable of work for a continuous period of not less than one year and then is certified as permanently incapable of work. The earliest date on which the person concerned can be considered for invalidity pension therefore is January 1985.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Kerry in view of the fact that she is sending in medical certificates; and if he will make a statement on the matter.

The person concerned claimed disability benefit from 16 January 1984 and payment was issued from 19 January 1984, the fourth day of incapacity, to 24 January 1984. However, because of an administrative error payment ceased from 25 January 1984. This error has now been rectified and payment of all benefit due from 25 January 1984 to 13 March 1984, the date of the latest medical certificate received, was issued on 22 March 1984.

asked the Minister for Social Welfare the grounds on which payment of unemployment benefit has been refused to a person (details supplied) in County Donegal.

Availability for work is a condition of entitlement to unemployment benefit and to fulfil this condition an applicant must be capable of, available for and genuinely seeking employment. The person concerned claimed unemployment benefit and her claim was disallowed on the grounds that she was not available for work. She appealed against the disallowance and attended an oral hearing of her case on 8 November 1983, but the appeals officer also decided that she was not available for work. She applied again for unemployment benefit on 21 March 1984. Inquiries are being made as to her present availability and a decision on this claim will be taken in the light of these inquiries.

It has recently come to notice that the person concerned was employed from February 1980 to November 1980 and the question of outstanding employment contributions is being investigated by an outdoor officer of the Department. The person concerned will be informed of the outcome.

asked the Minister for Social Welfare when arrears of disability benefit will be paid to a person (details supplied) in County Donegal.

The person concerned claimed disability benefit from 2 November 1983 and all benefit due to 20 March 1984, the date of the latest medical evidence received, has been issued. A delay occurred initially in issuing payment as it was necessary to make inquiries regarding her employment in Northern Ireland before payment could be made.

asked the Minister for Social Welfare the reason for the delay in deciding on an appeal regarding small holders unemployment assistance for a person (details supplied) in County Donegal.

Following a re-investigation of his unemployment assistance claim the means of the person concerned were reassessed at £16.35 per week from 24 August 1983 derived from profit from his land. He appealed against the amount of means assessed against him but on 8 November 1983 an appeals officer also assessed his means at £16.35. He was accordingly entitled to unemployment assistance at £11.65 per week from 24 August 1983, increased to £13.05 per week from 5 October 1983 and weekly payments continue to be made to him. He was notified by post of the appeals officer's decision which issued to him on 16 November 1983.

asked the Minister for Social Welfare when a decision will be made on an appeal regarding small-holders unemployment assistance for a person (details supplied) in County Donegal.

An appeals officer reduced the amount of means derived from the profit from land assessed against the person concerned from £67.30 weekly to £57.65 weekly with effect from 14 December 1983. He is accordingly entitled to unemployment assistance at £15.95 and all arrears due were paid last week. Weekly payments of unemployment assistance at £15.95 continue to be made to him as they become due.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Donegal.

Following the completion of inquiries the means of the person concerned have been assessed at nil with effect from 2 November 1983. He is accordingly entitled to unemployment assistance at £28 weekly and arrangements have been made to pay all arrears due this week. Further weekly payments will be made as they become due.

520.

asked the Minister for Social Welfare the present position regarding an application for unemployment benefit made by a person (details supplied) in County Galway; and if his Department will establish, as a matter of urgency, that he is available for employment and does not have an adequate income at present.

The entitlement to unemployment benefit from 29 February 1984 of the person concerned could not be determined until inquiries to establish that he was capable of, available for and genuinely seeking work had been completed. These inquiries have now been completed and his claim has been allowed at £82.50 weekly being the maximum rate appropriate in his case. Arrangements have been made to pay all arrears due this week and weekly payments will follow as they become due.

asked the Minister for Social Welfare when unemployment benefit will be paid to a person (details supplied) in County Kerry.

The unemployment benefit claim of the person concerned was allowed at the weekly rate of £65.60 and all arrears due less the amount of supplementary welfare allowance which he received pending the outcome of his claim have been paid. Weekly payments commenced on 16 March 1984 and will continue to be made as they become due.

asked the Minister for Social Welfare when a decision will be made on an application for unemployment assistance from a person (details supplied) in County Limerick.

The unemployment assistance claim of the person concerned was disallowed on the grounds that his means derived from benefit from his wife's earnings exceeded the statutory limit. He obtained an application form to enable him to appeal against the amount of means assessed against him. When he completes and returns this form his case will be referred to an appeals officer and his entitlement to unemployment assistance will be reviewed in the light of the decision of the appeals officer.

asked the Minister for Social Welfare when unemployment assistance will be restored to a person (details supplied) in County Limerick.

Following the completion of inquiries the person concerned was assessed with nil means and he is accordingly entitled to unemployment assistance at the weekly rate of £75.10. He is a postal applicant and he has been requested to furnish certificates of unemployment signed at his local Garda station on receipt of which weekly payment will commence. He has been in receipt of supplementary welfare allowance pending the outcome of his unemployment assistance claim and when the amount to be recouped to his local health board is known the balance of any arrears of unemployment assistance due to him will be paid.

asked the Minister for Social Welfare the reason unemployment benefit has not been granted to a person (details supplied) in County Tipperary as she was on disability benefit to 2 December 1983 and did not resume work in her old job as the working hours were way above average but subsequently enrolled with the National Manpower Service and has looked unsuccessfully for various jobs; when it will be paid; the amount that will be paid; and the amount of arrears that will be granted.

The person concerned claimed unemployment benefit from 2 December 1983 but, following the completion of inquiries to ascertain what efforts she was making to find work, her claim was disallowed on the grounds that she was not available for employment. She has appealed against the disallowance and arrangements are being made to have her case determined by an appeals officer. Her entitlement to unemployment benefit will be reviewed in the light of the decision of the appeals officer.

525.

asked the Minister for Social Welfare the reason an invalidity pension has not been granted to a person (details supplied) in County Tipperary as he suffers from severe heart disease and has been on disability benefit for five years; and when it will be granted.

The person concerned has been in receipt of disability benefit since 7 March 1979 and payment has been made to date. A form on which to claim invalidity pension has been forwarded to him and on its return, duly completed, the claim will be dealt with without delay.

The person concerned has claimed retirement pension which has been awarded to him at the rate of £45.10 per week from 19 January 1984. The pension book payable from 12 April 1984 will be issued to the designated post office of payment shortly and arrears in respect of the period from 19 January 1984 to 11 April 1984, less the amount of disability benefit paid during that period, will be paid by payable order. He is qualified to receive invalidity pension at the rate of £39.75 per week which is £5.35 lower than the rate of retirement pension to which he is entitled. Should he claim an invalidity pension, a free travel pass would be issued to him automatically. A free electricity allowance, free (black and white) television licence are also available to invalidity pensioners subject to certain conditions. Invalidity pensioners who live alone or with one other person who is permanently incapacitated may also apply for free telephone rental allowance. These schemes do not, however, apply to recipients of retirement pension until they reach the age of 66 years.

The person concerned is being advised of the position and asked to state whether, in the circumstances he wishes to pursue his application for invalidity pension.

526.

asked the Minister for Social Welfare the reason disability benefit has not been paid to a person (details supplied) in County Tipperary; and when it will be paid.

The person concerned claimed disability benefit from 20 February 1984. He is not qualified for benefit as he had less than the required minimum of 26 contributions paid or credited in 1982-83 the contribution year governing his claim. According to the records of the Department he has 19 contributions paid in 1982-83. As long as he remains incapable of work he should, however, submit medical evidence to this effect and credited contributions will be allowed to him which will maintain the continuity of his insurance record.

527.

(Limerick West) asked the Minister for Social Welfare when investigations will be completed so that an application from a person (details supplied) in County Limerick for a non-contributory old age pension can be paid.

The old age pension claim of the person concerned has been investigated and referred to the local pension committee for decision. Pension at the weekly rate of £18.60 has been recommended by the social welfare officer with effect from 15 February 1984. This is the rate of pension to which he is entitled having regard to the assessment of his means consisting of the weekly value of a holding and capital. The appropriate pension book payable from 15 February 1984 has been issued to the pensioner.

asked the Minister for Social Welfare when a person (details supplied) in County Cavan applied for social assistance; and when a decision will be made on her claim.

The person concerned applied for a single woman's allowance on 10 November 1983 and her case was referred to a social welfare officer for investigation. Extensive inquiries are still being made in the case and when they are completed, her means will be assessed and her entitlement to a single woman's allowance will be determined accordingly.

529.

asked the Minister for Social Welfare the reason retirement pension has not been paid to a person (details supplied) in County Mayo.

One of the conditions for receipt of a retirement pension under the Social Welfare Acts requires a person to have contributions paid in respect of at least 156 weeks of insurable employment since his entry into insurance. The Department's records show that the person concerned had 47 paid contributions since the beginning of the 1953 contribution year and 15 paid contributions prior to 1953. Under the regulations the 15 contributions paid prior to 1953 may be regarded as being equal to 22 thus bringing his total number of paid contributions up to the equivalent of only 69. He does not, therefore, qualify for a retirement pension. Neither will he qualify for an old age contributory pension at age 66 as a similar condition applies in respect of this latter pension. He should apply for a non-contributory old age pension approximately four months before he reaches age 66. He is in receipt of unemployment assistance at present.

asked the Minister for Social Welfare the reason unemployment assistance has been refused to a person (details supplied) in County Mayo.

The unemployment assistance claim of the person concerned was disallowed on the grounds that by failing to furnish full details of his means he failed to show that his means did not exceed the statutory limit. He recently appealed against the decision and he is being given a further opportunity to fully disclose his means before his appeal is submitted to the appeals officer for a decision. His entitlement to unemployment assistance will be reviewed in the light of the appeals officer's decision.

asked the Minister for Social Welfare when the maximum rate of unemployment assistance will be paid to a person (details supplied) in County Kilkenny as she has been in receipt of only £16.60 for the past nine months.

The person concerned was assessed with means of £12.80 from 18 June 1983. Her means were derived from the value of board and lodging on her parent's holding. Accordingly, she was entitled to payment of unemployment assistance at £12.65 weekly increased to £16.60 from 5 October 1983. She appealed against the amount of means assessed against her and an appeals officer also assessed her means at £12.80. Weekly payments of £16.60 continue to be made as they become due.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Kilkenny.

Entitlement to unemployment assistance is subject to the condition that an applicant is capable of, available for and genuinely seeking work. The person concerned, who is a postal applicant for unemployment assistance, has been written to on several occasions and asked to state what efforts she has made to find employment but has not replied to date. She will be again written to about her efforts to find work and her entitlement to unemployment assistance will be determined in the light of her reply to the inquiries.

To re-qualify for unemployment benefit she would require to have a minimum of a further 13 weeks of insurable employment for which the appropriate rate of contribution has been paid in respect of employment after she had received 156 days of unemployment benefit. She was engaged in part-time employment after the exhaustion of 156 days of unemployment benefit and her case is at present being investigated by a social welfare officer to establish whether the contributions payable by her are appropriate to a class providing cover against unemployment. Her entitlement to unemployment benefit will be determined in the light of the outcome of the investigations.

It has not been possible to trace receipt of a claim to unemployment assistance which refers to the person named in the details supplied. Further inquiries in the matter will be made if the Deputy will furnish additional information to enable the person concerned to be identified.

asked the Minister for Social Welfare the reason for the six month delay in deciding to review the unmarried mother's allowance being paid to a person (details supplied) in Dublin 9.

The person concerned reapplied for unmarried mother's allowance on 26 October 1983. Her application was disallowed because it was decided that her annual earnings exceeded the statutory limit of £2,600 i.e. £50 per week. She appealed against the decision and an oral hearing of her case was held on 14 March 1984. At the hearing she said she would supply further evidence in support of her application. The appeals officer has deferred his decision until the additional information, which is at present awaited, has been received.

asked the Minister for Social Welfare when unemployment benefit will be paid to a person (details supplied) in County Wexford.

The person concerned claimed unemployment benefit on 16 January 1984 but he does not qualify for benefit because his employment during the governing contribution period 6 April 1982 to 5 April 1983 was insurable at a class of contribution which does not provide cover against unemployment. He applied for unemployment assistance on 23 March 1984 and his case has been referred to a social welfare officer for inquiries into his means. When these inquiries are completed his entitlement to unemployment assistance will be determined in the light of the means assessed against him.

asked the Minister for Social Welfare when unemployment benefit will be paid to a person (details supplied) in County Wexford.

The person concerned claimed unemployment benefit from 15 September 1982 but her claim was disallowed on the grounds that she had insufficient contributions during the governing contribution period, 6 April 1980 to 5 April 1981. She qualified for unemployment assistance, however, and all payment due up to 9 August 1983 when she ceased to sign the unemployment register was made.

The person concerned claimed unemployment benefit on 6 February 1984. Her case is being examined to establish whether she fulfils the condition of being available for work. Her entitlement to unemployment benefit will be determined in the light of the outcome of these inquiries.

Entitlement to unemployment benefit for the person concerned was for a maximum of 312 days which expired on 2 December 1983. To requalify for unemployment benefit she would need to have a minimum of a further 13 weeks of insurable employment for which the approrpiate rate of contribution has been paid in respect of employment after she had received 156 days of unemployment benefit. She was engaged in part-time employment after the exhaustion of 156 days of unemployment benefit and her case is at present being investigated by a social welfare officer to establish whether the contributions payable by her are approrpirate to a class providing cover against unemployment. Her entitlement to unemployment benefit will be determined in the light of the outcome of the investigations.

asked the Minister for Social Welfare the reason unemployment assistance was refused to a person (details supplied) in County Wexford.

The unemployment assistance claim of the person concerned was disallowed on the grounds that his means from self-employment as a tractor and hedge cutter operator exceeded the statutory limit. Although advised of his right to appeal against this decision he did not do so. He has not signed as unemployed at his local office since 8 March 1983.

asked the Minister for Social Welfare the reasons a person (details supplied) in County Galway has not been paid a single woman's allowance; the weekly amount and total arrears to be paid; the date on which she will be paid; and if he will make a statement on the matter.

An appeals officer assessed the means of the person concerned at between £1 and £3 derived from board and lodgings. Accordingly, she is entitled to payment of single woman's allowance at £31.05 from 14 August 1983. An allowance order book was sent to the post office nominated by her on 1 March 1984 and arrears due were sent to her on 14 March 1984. This Department were recently notified that the book was not received in the post office. A new book payable from 5 April 1984 is being issued to her and arrears due will be paid when the inquiries being made by An Post about the missing pension book have been completed.

asked the Minister for Social Welfare if his Department will immediately pay the remaining unpaid unemployment assistance for a person (details supplied) in County Galway who was recently deceased; the amount to be paid; the date on which it will be paid and if he will make a statement on the matter.

The person concerned who died on 5 March 1984 was paid unemployment assistance up to 28 February 1984 at the weekly rate of £10.60. He was however overpaid unemployment assistance amounting to £19 in respect of his child who attained the age of 18 years on 11 February 1984. The amount overpaid to him exceeds the amount due to his estate in respect of unemployment assistance due from 29 February 1984 to 5 March 1984 and accordingly there is no payment of unemployment assistance due to his next of kin.

asked the Minister for Social Welfare the reasons unemployment benefit or assistance has not been paid to a person (details supplied) in County Galway despite the fact that he has been signing for some time; the weekly amount and total arrears that he will receive; the date on which he will be paid; and if he will make a statement on the matter.

The person concerned received unemployment benefit until 31 January 1984 when his claim ceased on receiving the maximum entitlement of 390 days benefit. To requalify for unemployment benefit he would require 13 employment contributions at the appropriate rate in respect of week of employment after the 156th day of his unemployment benefit claim.

He applied for unemployment assistance on 1 February 1984 and his case was referred to a social welfare officer for inquiries into his means. These inquiries have now been completed and he was assessed with nil means and entitled to unemployment assistance at the weekly rate of £92.35.

Arrangements have been made to pay all arrears due this week less advance of supplementary welfare allowance which was paid to him pending a decision on his case. The net amount of unemployment assistance due, including payment for week ending 27 March 1983 is £213.45. Further weekly payments will be made as they become due.

The person concerned claimed unemployment assistance on 15 July 1983 following exhaustion of his entitlement to unemployment benefit. He was assessed with means of £27.30 per week derived from board and lodging on his parents' holding. This entitled him to £0.70 per week from 15 July 1983 increasing to £2.10 from 5 October 1983. He appealed against the assessment of his means but an appeals officer also assessed his means at £27.30 per week. He has received all unemployment assistance to which he is entitled since 15 July 1983 and continues to be paid at the rate of £2.10 per week. He has applied for a review of his means and the case has been referred to a social welfare officer. When the investigations are completed the assessment of his means will be reviewed and his entitlement to unemployment assistance will be determined accordingly.
