asked the Minister for Justice the law under which prosecutions were taken for "loitering with intent" in 1982, as recorded in the Garda Commissioner's Report.

Limerick East): I am informed by the Garda authorities that it would take a disproportionate amount of time and effort to extract the records of the individual cases but that it may be taken that the prosecutions in question were brought for offences under section 4 of the Vagrancy Act, 1824 other than “loitering with intent”. The relevant part of section 4 providing for the offence of “loitering with intent” was found to be unconstitutional in 1980. The statistics recorded under this heading in the 1981 and 1982 Reports of the Commissioner should, in fact, have them recorded in the category covering offences under the Vagrancy Acts. The classification of “loitering with intent” will not be appearing in the 1983 Report.
