Vol. 354 No. 9

Written Answers. - Social Welfare Benefits.

623.

(Limerick West) asked the Minister for Social Welfare if he will arrange for immediate payment of maternity benefit to a person (details supplied) in County Limerick.

There is no record in the Department of the receipt of a claim for maternity benefit from the person concerned. A claim form has been issued to her and her claim will receive attention upon its return.

624.

(Limerick West) asked the Minister for Social Welfare when unemployment benefit will be paid to a person (details supplied) in County Limerick.

The person concerned does not satisfy the contribution conditions for entitlement to unemployment benefit. The matter of non-payment of contributions is being investigated and when the inquiries are completed his entitlement to unemployment benefit will be reviewed.

625.

asked the Minister for Social Welfare the reason payment of unemployment assistance ceased for a person (details supplied) in County Wexford on the grounds he was not available for assessment.

The unemployment assistance claim of the person concerned was disallowed from 7 November 1984 on the grounds that by failing to furnish details of his means he failed to show that his means did not exceed the statutory limit. He recently appealed against this decision and arising out of contentions made by him in support of his appeal he will be given a further opportunity of co-operating with the social welfare officer investigating his means. His case has, accordingly, been referred to a social welfare officer for further inquiries and when these are completed his case will be referred to the appeals officer for determination and his entitlement to unemployment assistance will be reviewed in the light of his decision.

626.

asked the Minister for Social Welfare if he will set out in detail how a means of £35 per week was calculated in relation to a claim for unemployment assistance by a person (details supplied) in County Kilkenny, and if he will make a statement on this case.

The means of the person concerned were assessed by a deciding officer at £37.50 weekly derived from the value of board and lodging on this mother-in-law's holding. In calculating this amount the deciding officer took into consider ation the gross yearly value of the farm at £4,887.87 less expenses amounting to £2,262.23 incurred in earning that income leaving a net profit of £2,600. On a weighted basis the applicant, his wife and four qualified children were deemed to enjoy three-quarters of the net income namely £1,950 per annum or £37.50 weekly.

The person concerned appealed against the amount of means assessed against him and his case was referred to an appeals officer for determination. The appeals officer reduced the assessment of his means to £35 weekly. He is accordingly at present in receipt of unemployment assistance at £51.75 weekly being the appropriate rate £86.75 less £37 means.
