asked the Minister for Agriculture if Section 32 of the Dairy Produce Act, 1924, is still operative; and if he will make a statement on the matter.

While section 32 of the Dairy Produce Act, 1924, is still in operation, it is no longer really appropriate to present day circumstances.

A group in my Department is currently examining all aspects of the dairy produce legislation, including this issue, with a view to having it updated. There will be full consultation with farming and other interested organisations beforehand.

I am not very satisfied with that reply. Is the Minister aware that the Department under his control are operating illegally regarding payment for milk?

Yes. It could be said that this is the case. I am not happy with the situation. I am anxious that present legislation should be updated.

The Minister has a responsibility to ensure that the Dairy Produce Act, 1924, is adhered to until such time as it is changed.

As I said, it is somewhat outdated and I am anxious to update it, which will be done as soon as possible. I am not happy with the situation pertaining at present where people pay for milk on a flat rate basis.

The Minister has been talking about diversification for the past half an hour and yet he is allowing people to pay for milk on a flat rate basis. I am not satisfied with the replies and I should like to raise this matter on the Adjournment.

I will communicate with the Deputy. The remaining questions will appear on tomorrow's Order Paper.
