asked the Minister for the Environment if he will introduce amending legislation to ensure that people cannot be prosecuted for not paying for a local authority service of which they do not avail.

The Local Government (Financial Provisions) (No. 2) Act, 1983, gives local authorities broad discretion in relation to charges for services provided to a person or in respect of a premises and gives sufficient scope for the equitable application of those charges without the need for amending legislation.
