asked the Minister for Foreign Affairs if he shares the concern expressed by Cardinal O'Fiaich with regard to those Irishmen convicted of the Birmingham bombings who are still in jail in Britain; if he believes there is a basis for retrial; if he has had any communication with the British authorities on their behalf; and if he will make a statement on the matter.

I am fully aware of, and appreciate, the concern expressed by Cardinal O'Fiaich in April 1983 with regard to those convicted of the Birmingham bombings. I am also aware that those convicted of the bombings continue to protest their innocence, and dispute the evidence upon which they were convicted.

However, the decision about whether there is the basis for a retrial is a matter for the British Home Secretary. Such decisions are taken when significant new evidence becomes available which has not already been before the courts. If such evidence were to become available in this case, the Irish authorities would be prepared to examine it closely with a view to making an appropriate approach to the British authorities.
