asked the Minister for Health if he considers that a person (details supplied) in Dublin 1 is being discriminated against; in respect of a medical card and if he will take action to rectify this.

I do not agree that the person in question is being discriminated against. It is understood that while the person is in receipt of a British invalidity social security pension he is employed (and living) in Ireland. The fact that the person is employed in the territory of this member state of the European Economic Community makes him subject to the legislation of this State in accordance with article 13 of Regulation (EEC) No. 2001/83. Accordingly, the person's eligibility for a medical card would be determined by the chief executive officer of the Eastern Health Board in the normal way. The board, in May 1985, having considered all the circumstances of the person in question deemed him ineligible for a medical card.
