Written Answers. - Retrospective Lump Sum Payment.

asked the Minister for the Environment when a person (details supplied) in Dublin 6 will be paid a retrospective lump sum affirmed by a decision of the Labour Court in January 1985; and if he will make a statement on the matter.

asked the Minister for the Environment if his approval has been sought to pay a retrospective lump sum affirmed by a decision of the Labour Court (details supplied); if so, if he is prepared to approve the application; and if he will make a statement on the matter.

I propose to take Questions Nos. 67 and 68 together. This case concerns a claim by a former employee of An Foras Forbartha who is now employed by the Institute for Industrial Research and Standards for payment of a lump sum in respect of a period while employed with An Foras and which was related to revised working arrangements and future productivity. When the Labour Court examined the case initially it was not satisfied that liability for payment rested with An Foras. The matter came before the Labour Court again by way of a claim against the Institute for Industrial Research and Standards and the court on this occasion took a different view and recommended that An Foras was liable for payment. An Foras were not present at the hearing of this claim. I understand from inquiries I have made of An Foras that the board has decided that taking account of all the circumstances of the case it would be inappropriate for An Foras Forbartha to implement the recommendation.
