asked the Minister for Foreign Affairs if he shares the view of the Fourth Joint Committee on the Secondary Legislation of the European Community that the Irish ministerial regulations giving effect to EC directives should reflect the legislative supremacy of the Oireachtas within the national system; and if he will make a statement on the matter.

I assume that the Deputy's question refers to the view expressed in paragraph 6 of report No. 23 of the Fourth Joint Committee on the Secondary Legislation of the European Communities dated 18 December 1985. The making of statutory regulations for the implementation of EC directives in the form referred to in that report, where this is considered appropriate, does not fail to reflect the legislative supremacy of the Oireachtas. The statutory regulations in question are invariably made pursuant to powers conferred on Ministers by Act of the Oireachtas, in particular the European Communities Act, 1972. Accordingly the legislative supremacy of the Oireachtas is duly reflected and fully respected.
