asked the Minister for Justice the number of cases that were determined by the High Court in each of the years from 1982 to 1985 inclusive, by way of appeal from decisions made by the Circuit Court in applications for decrees of divorce a mensa et thoro; and if he will state: the number of cases in each of the said years in which an appeal against the granting of such decree by the Circuit Court was (a) successful; and (b) unsuccessful; and the number of cases where, following the Circuit Court having declined to grant a divorce a mensa et thoro, an appeal seeking the granting of such a decree was (a) successful and (b) unsuccessful.

asked the Minister for Justice the number of cases determined by the Supreme Court in each of the years from 1982 to 1985, inclusive, by way of an appeal from a decision made in divorce a mensa et thoro proceedings that were determined by the High Court; and the number of decrees of divorce a mensa et thoro granted by the Supreme Court in each of the said years.

I propose to take Questions Nos. 142 and 143 together. The particulars requested are as follows:

In the years in question, no case in which the Circuit Court declined to grant a decree for divorce a mensa et thoro was determined by way of appeal to the High Court.

Supreme Court

The Supreme Court did not determine, in the years 1982 to 1985, inclusive, any case by way of appeal from a decision of the High Court made in divorce a mensa et thoro proceedings.
