asked the Minister for Justice the investigation, if any, the Garda have conducted into allegations of financial irregularities in the operation of a co-operative society (details supplied); if a file has been submitted to the Director of Public Prosecutions; and if he will make a statement on the matter.

It is not the practice for Ministers for Justice, unless there are exceptional circumstances indicating otherwise, to disclose whether or not a particular individual or organisation is the subject of a Garda investigation.

Where a Garda investigation discloses evidence of a crime it is for the gardaí to decide whether it is necessary for the file to be forwarded to the Director of Public Prosecutions for a direction in regard to the taking of a prosecution.
