asked the Minister for Industry and Commerce when a person (details supplied) in County Clare will be given a quote for his truck insurance as he applied for assistance, supplying all the documents to his Department in March, 1987.

The Declined Cases Agreement is an agreement between the authorised motor insurers and the Minister for Industry and Commerce for dealing with cases of inability to obtain third party motor insurance. The Declined Cases Committee, established under the agreement, examine cases referred to them by my Department where motorists have been declined cover by five or more insurance companies, and nominate a company to quote for the risk involved. Before a case can be submitted to this committee for consideration it is necessary for my Department to have copies of written refusals from five insurance companies together with details of any previous insurance held in the last three years. These details are important because the insurer first approached or the insurer with whom motor cover existed within the previous three years is normally obliged to quote for the risk.

The individual concerned in this case was asked in January 1987 to submit five written refusals. The fifth refusal was received in July 1987 and was then submitted to the Declined Cases Committee. A particular company were nominated to provide a quote but they pointed out that, according to the information provided by the proposer, he already had motor insurance with another motor insurer. The proposer to date has been unable to clarify what motor insurance he holds or has held in Ireland and with what insurer. Until this matter has been resolved no quote can be obtained by the Declined Cases Committee. The committee are endeavouring to establish the exact position with a view to providing the cover sought as soon as possible.
