Written Answers. - Law Reform Commission.

31.

asked the Taoiseach if he will make a statement regarding the Law Reform Commission indicating the reports which have been produced during the past two years; and the steps which are being taken to implement the various recommendations made.

The information sought by the Deputy is contained in a statement which I propose to circulate in the Official Report.

1. Reports produced by the Law Reform Commission during the past two years.

(a) Report on the Statute of Limitations; Claims in respect of Latent Personal Injuries.

(b) Report on the Hague Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial matters.

(c) Report on Receiving Stolen Property.

(d) Report on Rape.

(e) Report on the Rule Against Hearsay in Civil Cases.

(f) Report on Malicious Damage.

2. Action taken or proposed in respect of each report.

(a) Report on the Statute of Limitations.

A Private Members Bill was introduced by Deputy George Birmingham on 3 March 1988 which is modelled on a draft scheme proposed by the Law Reform Commission in their report.

The Government have decided to support the Bill in principle subject to certain amendments, mainly of a technical or drafting nature, which the Minister for Justice will propose.

(b) Report on the Hague Convention on the Service Abroad of Judicial and Extrajudicial Documents in Civil or Commercial Matters.

This report is being considered in the Department of Justice and it is hoped that the Hague Convention will be ratified shortly.

(c) Report on Receiving Stolen Property.

Work on the drafting of a Bill in this respect is at an advanced stage.

(d) Report on the Rule Against Hearsay in Civil Cases.

This report has just been received in the Department of Justice and is being examined, with a view to preparing legislation.

(e) Report on Rape.

A Bill to give effect to the recommendations of this report is being drafted. It is hoped that it will be published shortly.

(f) Report on Malicious Damage.

This report, which has just been published, is being examined in the Department of Justice with a view to preparing legislation.
