asked the Minister for Justice if it is his intention to introduce a driver rectification scheme which would allow an owner and driver of a defective vehicle an opportunity to remedy such defect within a defined period to avoid prosecution.

A provision of the type referred to in the question already exists by virtue of section 20, subsection (3) of the Road Traffic Act 1961.

46.

asked the Minister for Justice if he intends to introduce a scheme offering retraining to bad drivers under the road traffic code as an alternative to prosecution.

There is no provision under the Road Traffic Acts for the re-training of drivers who would otherwise face prosecution and accordingly I do not have power to introduce a scheme of the kind referred to in the question. Responsibility for these Acts rests with my colleague, the Minister for the Environment.
