asked the Minister for Social Welfare if he will re-investigate the case of contribution payment by the employer of a person (details supplied) in County Leitrim who claims that the proper rate of contribution was not paid by her employer.

The person concerned claimed disability benefit from 7 November 1985 and payment was authorised on the basis of her contribution record in 1983-84, the contribution year governing her claim. According to the records of the Department at that time she had 52 contributions paid at class A in this year.

Her insurance record was subsequently reviewed at the request of her employer and, following an oral hearing of the case on 24 November 1986, the appeals officer held that the employment from April 1983 was insurable at Class J. As contributions paid at this class are not reckonable for disability benefit purposes, payment of benefit was disallowed.

Following correspondence on the part of the person concerned the appeals officer agreed to re-open the case and a new hearing was scheduled for 2 October, 1989. However, this hearing was postponed at the request of the solicitors acting for the person concerned. The case will be re-scheduled for hearing by an appeals officer as soon as possible. The matter will be reviewed in the light of the appeals officer's decision.
