asked the Minister for Agriculture and Food the reason his Department will not allow a person (details supplied) in County Kilkenny to retain his milk quota where the farm was sold without the quota and his Department was notified to this effect; and if he will make a statement on the matter.

Under the Community Regulations on the quota system, milk quotas are attached to land. Where land transfers by sale or lease the corresponding milk quota transfers to the purchaser or lessee. In this case therefore the purchaser of the land is entitled to the quota.

asked the Minister for Agriculture and Food if he will arrange to have a milk quota made available to a person (details supplied) in County Kilkenny where all relevant information has been forwarded to his Department since January 1989.

Under the terms of the relevant regulations, the allocation of a Mulder quota can only be made in the case of a transfer of a holding, if the transfer took place before the expiry of the non-marketing period and if an undertaking, completed by the transferee, that he will carry out the conditions laid down in the scheme, was furnished to the Department at the time. In this case those conditions were not observed and consequently the person named is not eligible to be allocated a quota.
