asked the Minister for the Environment when he will announce the successful tenderer for the national incineration installation; if he will ensure that the EC EIA directive will be part of the environmental laws of the State before any planning application is made by the successful tenderer; and if he will make a statement on the matter.

In so far as the hazardous waste incineration facility is concerned, I would refer the Deputy to my reply to Question Nos. 21, 23, 26, 38 and 190 of 14 November 1989.

The legal measures necessary to complete the transposition into Irish law of the EC Directive on Environmental Impact Assessment will be finalised shortly. It has been made clear at all stages of the incineration facility project that the successful proposer will be required to comply with all environmental and planning laws, including an environmental impact assessment.
