Ceist:

216 Mr. Nealon asked the Minister for Justice the title and terms of reference of each commission, committee, working group or other similar body set up since 1 January 1986 to advise him on the policy or functions of his Department; the nature of each body, that is, whether it is permanent or ad hoc; when each ad hoc body reported; its recommendations; and the action, if any, which has been taken or is being taken in regard to same.

The information sought by the Deputy is set out in the attached statement.

The feasibility of setting up a permanent Night Court is still under consideration.

Garda Advisory Group.

April 1988

To act as a source of advice to the Minister for Justice on Garda management and on other non-operational Garda matters in relation to which professional skills and expertise drawn from outside the Force, can be expected to be of particular value.

The Group has, as a first project, undertaken an examination of administrative procedures within the Force and their advice on this is expected very shortly.

Committee on Fundraising Activities for Charitable and other purposes.

January 1989

To examine the adequacy of the existing statutory controls over fund-raising activities for charitable etc. purposes and to make recommendations for any changes considered necessary having regard, in particular, to the need to justify any consequential costs as well as any extra interference with individual freedoms.

The Report which has been published contains more than eighty recommendations and suggests they be incorporated in a new comprehensive statute.

The recommendations in the Report are being examined. It is intended that the charities sector and other persons affected by the Report should be given an opportunity to respond to it before the Minister draws up legislative proposals.

The Committee on Public Safety and Crowd Control.

April 1989

To examine and report to the Government on the adequacy of all existing provisions, including legislative provisions, relating to public safety and crowd control at major public events, kwith particular reference to sporting events and music festivals and concerts and to make such recommendations as seem to them appropriate.

Committee has recently submitted its report to the Minister.

Disclosure not appropriate until the matter submitted to Government.

Interdepartmental Group on the administration of Justice.

October 1989

To develop, on a co-ordinated basis, policy measures in relation to various areas of the criminal justice system.

The Group has not yet reported.

Committee to enquire into certain aspects of Criminal Procedure.

November 1989

(i) to examine whether there is need for a procedure whereby persons who have been convicted of criminal offences and who have exhausted the normal appeals procedures can have their cases further reviewed, and, if so, to make recommendations as to what procedure should be provided and in what circumstances it shoud apply, and

The Committee has not yet reported.

(ii) given that uncorroborated inculpatory admissions made by an accused to the Garda Síochána can be sufficient evidence to ground a conviction, to examine whether additional safeguards are needed to ensure that such admissions are properly obtained and recorded and to make recommendations accordingly.

Advisory Group on Prison Deaths.

November 1989

To examine the issue of death in prisons and to make recommendations in relation to any further measures which might be taken towards their prevention.

Sentence Review Group.

December 1989

To advise the Minister on an on-going basis in relation to the administration of long-term prison sentences, including life sentences.
