Vol. 396 No. 3

Written Answers. - Convicted Person Case.

John Bruton

Ceist:

41 Mr. J. Bruton asked the Minister for Justice whether a review is being undertaken on the way in which a person who believes he was wrongly convicted of manslaughter in 1973 may have his case re-opened with a view to having his innocence established.

A committee under the chairmanship of His Honour Judge Frank Martin are examining as a matter of urgency whether there is need for a procedure whereby convicted persons who have exhausted the normal appeals procedures, such as the person referred to by the Deputy, can have their cases further reviewed. If the committee consider that there is such a need, they will make recommendations as to the procedure for further review and the circumstances in which it should apply.

I expect to receive the committee's report in the near future.
