Written Answers. - Peace Commissioners.

Ceist:

60 Mr. J. O'Keeffe asked the Minister for Justice if any of the powers, duties, responsibilities and functions of peace commissioners have been found to be unconstitutional; and whether he proposes any amending legislation in relation to peace commissioners.

In a High Court judgment which was delivered on 6 July 1989 it was held that certain provisions of the criminal law which empowered a peace commissioner to remand a person in custody or on bail were repugnant to the Constitution. That decision is currently under appeal to the Supreme Court.

As regards amending legislation, for reasons which have been explained in this House on previous occasions, I could not undertake to indicate by way of reply to parliamentary questions, what specific proposals I might have in regard to legislation in a particular area.
