108 Mr. Gregory asked the Minister for Social Welfare if he will review the position of a person (details supplied) in Dublin 3 who is seeking unemployment assistance; and if he will make a statement on the matter.

Entitlement to unemployment benefit is subject to the condition that a claimant must be available for and genuinely seeking employment.

The person concerned claimed unemployment benefit on 19 February 1990. Her claim was disallowed by a deciding officer on the grounds that she was not available for and not genuinely seeking employment. She appealed against the disallowance. Following an examination of the facts of the case an appeals officer decided to hold an oral hearing to afford the applicant an opportunity to present her case fully. This oral hearng was held on 23 May, 1990. As a result of the hearing, which the applicant attended, the appeals officer upheld the deciding officer's decision and the applicant was informed accordingly.
An appeals officer's decision is final and conclusive in the absence of fresh facts or new evidence.
