Under the local government superannuation code payments for overtime are not, except on the direction of the Minister, included as part of an employee's wages for the purposes of determining a superannuation award. The conditions under which such a direction may be given are set out in a circular letter which my Department issued to local authorities in 1979. Where the conditions are met a local authority may seek the necessary ministerial direction.
In the case of the person concerned the local authority, being of the opinion that the conditions of the circular letter were not met, did not seek a direction from me to have his overtime payments regarded as wages for superannuation purposes.
