Written Answers. - Prison Transfer Application.

Ceist:

148 Mr. McCartan asked the Minister for Justice if he has fully considered the application of an Irish person (details supplied) serving a sentence of imprisonment in Canada, for a transfer to a prison in Ireland to complete his sentence; if he will grant the application; and if he will make a statement on the matter.

I have considered the application from the person referred to and the position is that it is not possible to arrange for the transfer of an offender from another jurisdiction to serve his or her sentence in this country in the absence of any international agreements providing for it.

As explained in reply to Dáil Questions Nos. 197 and 201 on 24 October 1990, Official Report: Vol. 402 No. 1 Col. 197, examination of measures which would be necessary to enable Ireland to ratify the Council of Europe Convention on the Transfer of Sentenced Persons is under active consideration within my Department.

The case referred to by the Deputy can be considered in the light of decisions made in relation to this Convention — Canada has already ratified the Convention.
