Written Answers. - Disadvantaged Areas Scheme.

41 Mr. M. D'Arcy asked the Minister for Agriculture and Food if he will outline the terms of reference with regard to the appeal system available to applicants refused entry into the disadvantaged areas scheme; and if he will outline the acreage he is prepared to submit to the EC for approval under the proposed appeal system.

96 Mr. Yates asked the Minister for Agriculture and Food when the appeal board in relation to the reclassification of the disadvantaged areas scheme will commece their work; whether they will be limited to 1.5 per cent of national territory as the total amount that can be submitted to an appeal basis for approval to the EC authorities; when it is expected they will conclude their work; whether the extra lands that they propose to be included in the disadvantaged areas will have retrospective approval for EC subsidies this year; and if he will make a statement on the matter.

I propose taking Questions Nos. 41 and 96 together.

As I announced yesterday at a preliminary meeting of the disadvantaged areas appeals panel, their terms of reference are: to act as an appeal body in connection with formal appeals by groups of farmers representing particular district electoral divisions or townlands against the exclusion of their areas from the list of less-favoured areas or against the classification accorded to their areas; to determine the matter in which such appeals may be made; to consider such appeals in the light of the departmental survey data already available and to arrange for futher surveying by the Department of areas where the panel consider this necessary and to make recommendations to the Minister in regard to areas which, in the opinion of the panel, meet the criteria laid down by or agreed with the EC Commission.

The appeal panel will meet next week to initiate the appeals process. I do not wish to place any restrictions on the acreage to be considered by the panel or to insist that they finish their work within a given time lest such restrictions might hinder them in dealing fairly with all possible appeals.

I propose to take Questions Nos. 42 to 71, inclusive, and 78 to 95, inclusive, together.

The criteria for designation of areas are those specified in Council Directive 85/350/EC of 27 June 1985, published in the Official Journal of the European (Community) No. L.187 of 19 July 1985, pages one and two. As the Deputies will know, designation is not specifically determined on the basis of individual townlands but on homogeneous areas which may embrace DEDs or a number of townlands.

I have set up an appeals panel to consider appeals from areas not included in the recent Commission proposals, a facility which, I may add, was not available to the many farmers excluded from the previous extension in 1985.
