Ceist:

99 Mr. Browne (Wexford) asked the Minister for Social Welfare the reason unemployment benefit has been refused to the workers of a company (details supplied) in County Wexford who are not on strike but are out of work because the company involved closed down production and refused to allow workers to report for work.

Social welfare legislation provides that a person who loses his employment by reason for a stoppage of work which was due to a trade dispute at his place of employment is disqualified for receiving unemployment benefit unless he comes within certain exempt categories.

In the opinion of the deciding officer the employees of the company concerned lost their employment because of a stoppage of work due to a trade dispute and were therefore disqualified for receiving unemployment benefit under the trade dispute provisions of the Act for the duration of the stoppage of work.

They have been advised of their right of appeal to the independent social welfare appeals office against the disallowance.
