Written Answers. - Disability Benefit Claim.

109 Mr. Deasy asked the Minister for Social Welfare if he will have a full investigation and examination carried out of the case of a person (details supplied) in County Waterford whose disability benefit claim was disallowed, in view of the fact that the person is clearly unfit to resume work.

The person concerned first claimed disability benefit in 1985. She was examined by two different medical referees in June and August 1990 respectively. These referees expressed the opinion that she is capable of work. Accordingly, payment of disability benefit was terminated with effect from June 1990.

Following an oral hearing on 9 January 1991 by an independent appeals officer, the decision terminating payment of disability benefit was upheld.

The person concerned continues to submit medical certificates for the same incapacity. In order to establish whether her medical situation had changed in a material way since the appeal, she was examined again on 9 May 1991 by a third medical referee who also expressed the opinion that she is capable of work.

The decision of the independent appeals officer is final and may only be altered in the light of new facts or fresh medical evidence.
