Written Answers. - Cork Disability Benefit Claim.

77 Mr. G. O'Sullivan asked the Minister for Social Welfare the reason disability benefit has not been paid to a person (details supplied) in Cork who made her claim on 12 December 1990 and who clearly qualified for the payment.

Under European Community legislation the country in which a claimant was last employed is the competent authority responsible for the payment of disability benefit.

The person concerned made a claim for disability benefit on 18 December 1990, stating that she was employed in Britain from 17 September 1990 to 28 September 1990. A claim was forwarded on her behalf to the Department of Health and Social Security in the United Kingdom. She was notified accordingly and advised to forward all further medical certificates to that Department.

The United Kingdom authorities have been contacted by my Department on a number of occasions and they have now indicated that a decision will be given on the claim at an early date.
