Written Answers. - Civil Servant Transfer.

Ceist:

78 Mr. Spring asked the Minister for Finance if he will make available to a former established civil servant (details supplied) copies of such documents, if any, purported to transfer the said officer from a Government Department (details supplied) on loan, or secondment, or to otherwise appoint him, as secretary of a State finance body (details supplied) effective form 1 January 1976; if he will outline the reason such documents, if any, have been withheld from the said officer to date; and if he will make a statement as to how such officer become secretary of the said State-financed body without the normal Civil Service procedures being followed.

As previously indicated to the Deputy documents, if any, of the kind alluded to in his question would appear to be relevant to legal proceedings (which solicitors acting for the person named have indicated may be taken against the Attorney General, the body concerned and the Minister for Finance) thus making it inappropriate to supply them to a plaintiff.

The body in question is an independent body, established under a statute and its staff (other than clerical staff who are civil servants) are appointed by the body under specified statutory arrangements. These arrangements — like those of many other State financed bodies — differ from those applicable to Civil Service posts and do not involve Civil Service recruitment or transfer procedures.
