Written Answers. - Holiday Entitlement.

424 Mr. Bell asked the Minister for Labour if he will outline the progress made by his Department in establishing the holiday entitlement and pay due for the years 1985 to 1991 in accordance with the provision of the Holidays Employers Act, 1973, to a person (details supplied) in County Louth; the steps he proposes to take to secure payment of arrears due; and if he will make a statement on the matter.

A complaint by the person concerned that he had not received his public holiday entitlements under the Holidays (Employees) Act, 1973, has been under investigation by my Department. Difficulties have been experienced in establishing the precise entitlements due but my Department's investigation is now almost complete.

Under the provisions of the Holidays (Employees) Act, 1973, the Minister for Labour may institute proceedings for the recovery of outstanding payments from a defaulting employer. As soon as the entitlements of the employee in this case are established, I am prepared to exercise the discretion open to me and to pursue, subject to legal advice, the employer concerned in the event that the result of the investigation supports the complaint.
