Written Answers. - Conviction Inquiry.

Ceist:

68 Mr. McCartan asked the Minister for Justice if his attention has been drawn to the concerns surroundings the conviction of a prisoner (details supplied); if he proposes to carry out any inquiry into the case; and if he will make a statement on the matter.

The person referred to by the Deputy was convicted on a charge of rape and sentenced to 12 years penal servitude. He subsequently appealed the conviction to the Court of Criminal Appeal. His appeal was not successful and his application to take an appeal to the Supreme Court was also refused. Allowing for normal statutory remission he is not due for release until July 1997.

I have no reason to doubt that the full facts of the case were placed before the courts and that the courts took full account of any defence put forward by the accused. In the circumstances I am not satisfied that any action on my part would be appropriate or warranted.
