Written Answers. - EC Directives, Regulations and Recommendations.

Ceist:

103 Mr. Sargent asked the Minister for Justice if she will supply Deputy Sargent with a list of EC Directives, relevant to her Department, which have been signed by the Council but not yet due for transposition into Irish law; and when they are expected to be transposed.

104 Mr. Sargent asked the Minister for Justice if she will supply Deputy Sargent with a list of EC recommendations and regulations relevant to her Department issued during 1991; and the action, if any, taken on them.

105 Mr. Sargent asked the Minister for Justice if he will supply Deputy Sargent with a list of EC Directives relevant to her Department which are overdue for transposition into Irish law; and the expected date of their transposition.

I propose to take Questions Nos. 103, 104 and 105 together.

The position in relation to the Directives, regulations and recommendations in question made by the EC which are relevant to my Department is as follows:

—Sixth Council Directive 92/20/EEC of 26 March 1992, on summertime arrangements.

The legislation necessary to give effect to this Directive, Winter Time Order, 1992 (S.I. No. 371 of 1992), was made on 4 December 1992. The Order shall not come into operation untl such time as it has been approved by resolution of each House of the Oireachtas.

—Council Directive 91/308/EEC on prevention of the use of the financial system for the purpose of money laundering.

The date for implementaton is 31 December 1992. The legislation necessary to give effect to this Directive is being drafted as a matter of priority and will be introduced very shortly.

—Council Directive 91/477/EEC of 18 June 1991 on control of the acquisition and possession of weapons.

The date for implementation is 1 January 1993. It is proposed to bring the Directive into effect in Ireland by means of Regulations under Section 3 of the European Communities Act, 1972 (No. 27 of 1972). The drafting of the necessary regulations is being finalised at present.

—Council Directive 90/364/EEC, 90/365/EEC and 90/366/EEC which deal with rights of residence for non-economically active persons.

The legislation necessary to give effect to these Directives will be introduced shortly.
