Written Answers. - County Wexford Land Disposal.

Ceist:

110 Mr. Byrne asked the Minister for Agriculture, Food and Forestry the date on which the Land Commission received an application from a person (details supplied) for permission to sub-divide and the lifting of an inhibition on the sale of certain lands in County Wexford; the reason this permission was granted but no communication regarding the inhibition of sale was issued; the reason, if any, for refusing to lift the inhibition of sale; when this matter will be resolved; and if he will make a statement on the matter.

There are two separate issues involved here. One is the question of subdivision control which derives from Section 12 of the Land Act, 1965 and applies to all subdivisions. The other issue concerns the specific inhibition on the sale of certain lands without the consent of the Land Commission which dervies from the fact that part of the lands involved are the subject of a rearrangement scheme prepared by the Commission at the request of the landowner.

As details of individual application under Section 12 are not recorded I am not in a position to provide the information requested on the first issue.

On the issue of the inhibition on sale I can confirm that a request dated 29 January 1993 for consent to a transfer was received in the Land Commission on 2 February 1993. This request is being examined with a view to determining whether lands involved lie outside the scheme of rearrangement and thus whether consent can be given.

I would hope to have an early decision on this matter.
