Vol. 428 No. 5

Written Answers. - Right to Silence.

Helen Keogh

Ceist:

29 Ms Keogh asked the Minister for Justice her views on whether there is a need to restrict the right to silence so that in circumstances where a prima facie case exists, the accused person should be required to give evidence in court.

As I have already indicated in this House, I could not undertake to indicate, by way of reply to parliamentary questions, what specific legislative proposals I might have in a particular area. Any such proposals I may have will be announced in the ordinary way in due course.

However, I can say that I have no proposals to amend the general principle in law that a person should not be required to incriminate himself or herself in court.
