Ceist:

105 Mr. Hogan asked the Minister for Transport, Energy and Communications if there are any measures required to be taken in his remit of responsibility to comply with the terms of the Single Market; and if he will make a statement on the matter.

Single Market measures falling within my area of responsibility which have yet to be implemented are detailed in the Schedule below.

Council Directive 92/3 Euratom of 3 February, 1992 on the supervision and control of shipments of radioactive waste between member states and into and out of the Community.

The position in regard to implementation is as follows:
Item 1:
The delay in transposing this Directive is due to the complex nature of the transposing regulations and the necessity to consult with a variety of interests. Statutory provisions for implementation are expected to be made by 31 December, 1993.
Item 2:
The Department is currently finalising arrangements for the implementation of this Directive following an extensive process of consultation with tourism and travel industry representatives.
Item 3:
The requirements of this Directive are being complied with. Both ESB and BGE are supplying the necessary information and statistics by way of administrative arrangements. However, statutory effect to the Directive will be given by a provision contained in the Energy (Miscellaneous Provisions) Bill currently being drafted.
Item 4:
Measures implementing the Council Regulation have been undertaken on an administrative basis. Procedures to transpose the Regulation into domestic legislation have commenced.
Item 5:
Statutory provision for the implementation of this Directive are expected to be made by the end of September this year.
Item 6:
Statutory measures to give effect to this Directive will be taken within the timescale laid down in the Directive.
Other measures:
The Single Market in air transport for passengers and freight came into effect on 1 January, 1993. The Council Regulations giving effect to the Single Market are directly applicable in all member states. Statutory Instruments are being prepared under the Air Navigation and Transport Act, 1965 to bring existing domestic legislation into line with the provisions of the Regulations.
The Council of Ministers for Transport at their meeting in Luxembourg on 19 June 1993, agreed to the progressive introduction of full road freight cabotage by 1 July 1988. This agreement will enable Irish hauliers to carry out road haulage operations domestically within the territory of other EC member states. It is unclear until a final text of the agreement is available, what measures, if any, will require to be taken for its implementation.
