Ceist:

85 Mr. Noonan (Limerick East) asked the Minister for Transport, Energy and Communications if the maximum fine of £1,000 which may be imposed on companies which employ illegal hauliers has ever been applied; if any cases have been brought under this section in the years 1993, 1992 or 1991; and if he will make a statement on the matter.

Prosecutions for the offence referred to by the Deputy may be initiated by transport officers of my Department or the Garda Síochána.

The Garda authorities, however, are unable to report separately on this offence within the general category of offences under the Road Transport Acts. Arising from investigations by officers in my Department legal proceedings were brought against companies for employing illegal hauliers as follows: 1991, four; 1992, four; 1993, one (three cases pending).

My Department has no record that a £1,000 maximum fine was ever imposed on a company for employing an illegal haulier.
