356 Mr. E. Kenny asked the Minister for Agriculture, Food and Forestry if a person (details supplied) in County Mayo is entitled to headage payments in view of their payment to him in former years.

On the basis of acreage declared by the person named on his application forms for mountain and lowland grazings it would appear that he was overpaid under the 1991 and 1992 sheep headage schemes. However, I have arranged to have an examination of the lands in question carried out to determine exactly what area of the holding can be classified as mountain or lowland grazings and I will get in touch directly with the Deputy regarding the outcome.

357 Mr. Allen asked the Minister for Agriculture, Food and Forestry the reason a person (details supplied) in County Cork has been found ineligible for the 22 month scheme.

The 22 month instalment of the Special Beef Premium is payable on animals aged 21 months and over at time of application.

His June 1993 application consisted of ten animals, four of which were shown as born in December 1991 and six born in January 1992. As these animals were not 21 months of age or over at time of application in June 1993, the person named was so informed, in writing on 10 November 1993 at which time he was also advised that the animals in question would be eligible to be claimed on in the application period ending 30 November 1993.

359 Mr. Dukes asked the Minister for Agriculture, Food and Forestry if he intends to provide for a comprehensive programme for the eradication of Bovine TB over the next three years; and if so, if such a programme will include a full test of every herd in the country each year.

The Programme for Government contains a commitment to implement a coherent four year Bovine TB eradication programme. In this regard it is proposed to continue to carry out a full annual testing programme on the national herd, which includes an annual test on every herd.

370 Mr. Crowley asked the Minister for Agriculture, Food and Forestry when a cattle headage grant, equine headage and area aid grant will be paid to a person (details supplied) in County Cork.

The person named was paid advances of his 1993 Cattle Headage Grant on 27 November 1993 and his 1993 Equine Headage grant on 31 December 1993. These applications are being processed further at present and if found in order the balances will be paid in February 1994.

There is no record of any application for Arable Area Aid from the person named.

371 Mr. Gregory asked the Minister for Agriculture, Food and Forestry the number of hares killed so far in the 1993/1994 coursing season; and the meetings concerned.

372 Mr. Gregory asked the Minister for Agriculture, Food and Forestry the number of hares killed or injured at the Dundalk and Dowdall's Hill coursing meeting on 26 and 27 December 1993.

I propose to take Questions Nos. 371 and 372, together.

The number of hares killed during the 1993-94 coursing season up to and including 16 January, 1994 was 285 at 8,004 courses. Two thousand one hundred and nineteen courses were run with muzzled dogs resulting in 21 kills. A further 18 were injured and had to be put down. A list of coursing meetings is published each week in the Sporting Press.

At the Dundalk and Dowdall's Hill meeting on 26 and 27 December 1993 four hares were killed or died as a result of their injuries.

373 Mr. Deenihan asked the Minister for Agriculture, Food and Forestry the level of funding that was provided by the Irish Government for research and development in the agriculture and food industry in each of the years since 1990; and if he will make a statement on the matter.

Funding for research and development in the agriculture and food industry is provided by my Department mainly in the annual grant-in-aid to Teagasc. It is a matter for Teagasc, within the limits of the State and non-State resources available to it, to decide on the allocation of funds between the advisory, training and research activities. The State funding to Teagasc in the years 1990-1993 was as follows: 1990, £29.4 million; 1991, £33.0 million; 1992, £39.1 million; 1993, £36.5 million.

Funding is also provided for research and development in the agriculture and food industry in a number of areas within my Department, such as
—a sum of approximately £2.5 million is provided annually for research and testing in the veterinary research and other laboratories and
—a stimulus fund of £250,000 was provided in 1993 for collaborative inter-institutional research in the food area.
The 1994 Estimates for my Department provides £7 million for institutional research in the food industry.
Funding is also provided for research in the agriculture and food industries, through the Higher Education Authority, to the universities, the main ones being the Faculty of Food Science and Technology in UCC and the Faculties of Veterinary Medicine and Agriculture in UCD.
Funding may also be provided via a number of other Departments and agencies such as Department of the Marine (Structural Funds) and the IDA.

374 Mr. Deenihan asked the Minister for Agriculture, Food and Forestry if a suckler quota will be made available to a person (details supplied); and if he will make a statement on the matter.

The relevant EU Regulations provide for Suckler Cow Premium quota to be based on the number of eligible cows on which the producer was paid the premium under the 1992 Suckler Cow Scheme. In the event of non-payment due to the imposition of penalties, the number adopted shall be that recorded at the time of the inspection which gave rise to those penalties.

The person named applied for premium on nine cows under the 1992 Suckler Cow Scheme but at inspection only seven of the nine animals presented were accepted as cows. The person named therefore has a suckler cow quota of seven.

375 Mr. J. Higgins asked the Minister for Agriculture, Food and Forestry when headage payments will be made to a person (details supplied) in County Mayo.

The person named listed the tag number of an animal which was found at inspection to be an in-calf heifer on his 1993 Suckler Cow Premium application form. In accordance with EU regulations he must be debarred from the scheme for the 1993 and 1994 calendar years for the false declaration. My Department is prepared to review the case if the person named has further information which he wishes to be taken into consideration and he submits it to my Department.

His 1993 Cattle Headage grants will be paid shortly.

379 Mr. Deenihan asked the Minister for Agriculture, Food and Forestry when a grant under the suckler cow and beef premium schemes will be paid to a person (details supplied) in County Kerry.

The person named has already been paid 60 per cent advances under the 1993 Suckler Cow and June 1993 Special Beef Premium Schemes.

He did not apply for grants under the Special Beef Premium Scheme in the January-February 1993 application period.

380 Mr. Deenihan asked the Minister for Agriculture, Food and Forestry if the Land Commission has received the final result of an appeal to the High Court Appeals Tribunal regarding the compulsory division of a commonage in County Mayo; and if he will make a statement on the matter.

The Land Commission has not received the final result of the appeal to the High Court against the compulsory division of a commonage in County Mayo. In March 1992 the court directed that certain matters in that case should be clarified before returning the case to the court. Among these was the question of compliance with planning legislation. Subsequently the matter was referred to An Bord Pleanála. Late last year the decision of An Bord Pleanála was appealed to the High Court. This second appeal must be concluded before the initial appeal is resolved.

381 Mr. Deenihan asked the Minister for Agriculture, Food and Forestry if a person who has an RSI Number will have to obtain a new RSI number to qualify for a headage grant in 1994; and if he will make a statement on the matter.

Following discussions between Farm Organisations and Government Ministers it was agreed in March 1992, that RSI numbers would not be required for disadvantaged area headage payments until the beginning of January 1994.

From January 1994 onwards, farmers applying for disadvantaged areas headage payments which in total amount to between £500 or more will be subject to tax clearance. Farmers applying for headage payments of between £500 and £5,000 in any calendar year must state the following on their application form:

(i) the RSI number issued to them for tax purposes,

(ii) the tax office dealing with their tax affairs, and

(iii) that, to the best of their knowledge, their tax affairs are in order.

Farmers who are in receipt of a means tested Social Welfare payment will simply have to quote the RSI number under which the payment is made.

In the rare event of applications for headage payments totalling £5,000 or more in any one calendar year, farmers will be required to supply a tax clearance certificate from the Collector-General with their headage applications. Information about getting tax clearance certificates can be obtained from: The Collector General, Tax Clearance Section, Sarsfield House, Limerick.
A person who already has an RSI number will simply have to quote that number on the Disadvantaged Areas Headage Application forms.

382 Mr. Crowley asked the Minister for Agriculture, Food and Forestry when a beef premium will be paid to a person (details supplied) in County Cork.

Under EU Regulations governing the January-February 1993 Special Beef Premium Scheme animals on which premium was claimed should have been ear-punched on both ears at date of application.

383 Mr. Deenihan asked the Minister for Agriculture, Food and Forestry if it is intended to renew the agri-tourism scheme which finished in 1993 for the period 1994-1999; and if he will make a statement on the matter.

The National Development Plan 1994-1999 and Operational Programmes to implement aspects of the plan relating to agriculture, food, rural development and forestry are currently being examined by the EU Commission. These provide for the promotion of production of non-surplus farm products as well as the encouragement of alternative income creating rural enterprises including rural tourism.

A final decision regarding these measures cannot be made until the plan and programmes have been approved by the EU Commission.

384 Mr. Deenihan asked the Minister for Agriculture, Food and Forestry if a beef premium will be paid to a person (details supplied) in County Kerry.

The person named applied for one animal under the June 1993 22 month Special Beef Premium Scheme. However, as he neglected to indicate on the application the age of the animal in question, it was necessary for the Special Beef Unit to contact him to establish whether the animal was eligible. This resulted in a delay in processing his application for payment. The matter has now been clarified and his application is currently being processed for payment.

387 Mr. Deenihan asked the Minister for Agriculture, Food and Forestry the number of schemes that were grant aided under the agri-tourism scheme from 1989 to 1993 in County Kerry; and the amount of the total allocation involved.

A total of 15 projects, 11 individual and four group, have been grant aided to date in County Kerry under the Agri-tourism Scheme, operated as part of the Operational Programme for Rural Development. The grant allocation involved is £334,243.

388 Mr. McCormack asked the Minister for Agriculture, Food and Forestry the proposals, if any, he has to introduce a new alternative grant scheme for housing of horses and related matters grant aided in other schemes; and if he will make a statement on the matter.

389 Mr. McCormack asked the Minister for Agriculture, Food and Forestry his views on the concept that ewe quotas should be based on the circumstances of farmers in the last three months of the year when ewes are being let out.

In accordance with EU Regulations, ewe quotas in Ireland have been based on the number of eligible ewes held by a producer in 1991. There is no scope for changing the basis of establishment of the quotas at this stage.

390 Mr. Dukes asked the Minister for Agriculture, Food and Forestry the arrangements, if any, that have been made for the permanent staff and the temporary and seasonal staff currently employed by the Dublin District Milk board in the context of the establishment of the proposed National Milk Agency.

The staff members of the Dublin and Cork District Milk Boards have accepted an offer made to them by my Department, which in essence provides for the voluntary early retirement of some fifty members, the retention of the five or six suitably qualified members for the new National Milk Agency and the transfer of the rest to the private sector of the sale of Milk Boards' businesses. The staff transferring to the new Agency and the private sector will carry with them their existing terms and conditions of employment.

The person named has already been paid an advance under the 1993 Cattle and Equines Headage Scheme. His application for grants under the 1993 Suckler Cow Premium Scheme is being processed at present and if found in order a 60 per cent advance as provided in EU Regulations will be paid shortly.

With regard to his application for grants under the January/February 1993 Special Beef Premium Scheme he applied for premium in respect of six animals but as he failed to submit cattle identity cards for stamping and punching prior to sale of four of the animals as required under EU Regulations governing the Scheme he has been deemed ineligible for grants on these four animals. He has already been paid a 60 per cent advance in respect of the remaining two animals.

392 Mr. Crowley asked the Minister for Agriculture, Food and Forestry when a herd number will be allocated to a person (details supplied) in County Cork.

The application in this case is for a second herd number in respect of another member of the one family. As the applicant does not meet the existing criteria, principally separate management of the herds without intermixing and separate testing facilities, it has not been possible to issue a second herd number.

396 Mr. Crowley asked the Minister for Agriculture, Food and Forestry when the 1992 cattle headage grant will be paid to a person (details supplied) in County Cork.

The person named was not an applicant under the 1992 cattle headage scheme. He did however apply under the 1992 Ewe Premium and sheep headage schemes at which time he also applied for a flock number. Following examination of his application for a flock number it was considered that the issue of a flock number was not warranted as the lands relating to his sheep applications and the lands of his father were being operated as a single unit. Under the conditions of the sheep headage/ewe premium schemes applicants are required to have a flock or herd number to be eligible for payment and as the person named did not meet that requirement he was not eligible for any payments under the 1992 ewe premium and sheep headage schemes.

He did, however, apply under the 1993 ewe premium but he is not entitled to payment of any premium as he has no quota and he did not apply for a quota from the national reserve. He will be paid an advance of his cattle headage grant shortly. His application is being processed further at present and if found in order the balance will be paid in February 1994.
