172 Ms O'Donnell asked the Minister for Tourism and Trade, in regard to the area of his responsibility, the Directives or other measures requiring transposition under EU law which have been adopted by the EU Council or Commission but which have not yet been transposed by Ireland; the Directives or measures requiring transposition where the date for transposition has passed; the Directives or measures or other matters of EU law in respect of which the European Commission has issued a letter to Ireland under Article 169 (Infringement Proceedings) of the EC Treaty; the Directives, measures or matters in respect of which the European Commission has issued a reasoned opinion to Ireland under Article 169; the matters in respect of which proceedings against Ireland are pending before the Court of Justice of the European Union; the matters in respect of which a judgement of the Court of Justice of the European Union against Ireland has been given but has not been implemented; and the judgments in respect of which proceedings have been initiated under Article 171 (Failure to Implement Judgement) of the EEC Treaty.

There are no outstanding EU Directives or measures in regard to the area of my Department's responsibility currently requiring transposition into Irish law.

173 Ms O'Donnell asked the Minister for Transport, Energy and Communications in regard to the area of his responsibility, the Directives or other measures requiring transposition under EU law which have been adopted by the EU Council or Commission but which have not yet been transposed by Ireland; the Directives or measures requiring transposition where the date for transposition has passed; the Directives or measures or other matters of EU law in respect of which the European Commission has issued a letter to Ireland under Article 169 (Infringement Proceedings) of the EC Treaty; the Directives, measures or matters in respect of which the European Commission has issued a reasoned opinion to Ireland under Article 169; the matters in respect of which proceedings against Ireland are pending before the Court of Justice of the European Union; the matters in respect of which a judgement of the Court of Justice of the European Union against Ireland has been given but has not been implemented; and the judgments in respect of which proceedings have been initiated under Article 171 (Failure to Implement Judgement) of the EEC Treaty.

The present position in regard to EC Directives within my area of responsibility which have been adopted but which have not yet been transposed into Irish law is detailed in the Schedule which I will circulate in the Official Report. There are no other EU measures requiring transposition.

Under Article 169 of the EC Treaty letters have been received from the EC Commission in respect of item numbers 2, 3, 4, 6, 7, 9 and 12. Reasoned opinions have been received in respect of Item numbers 2, 6, 9 and 12.

Formal proceedings have been initiated against Ireland on 9 August, 1991 under Article 169 for alleged infringements of Community Law (under Articles 30, 34 and 37 of the EC Treaty) by retaining exclusive rights in relation to the import and export of electricity. As part of this procedure the Commission forwarded a reasoned opinion to the Irish authorities on 26 November 1992. A response to the reasoned opinion was issued to the Commission on 25 March 1993. A formal reply from the Commission has not yet been received.

No proceedings against Ireland are pending before the Court of Justice of the European Union in respect of the Directives yet to be transposed. No judgment of the Court of Justice of the European Union has been given against Ireland and consequently no proceedings have been initiated under Article 171.
