207 Mr. Deenihan asked the Minister for Agriculture, Food and Forestry when payment of the 22 month beef premium will be made to a person (details supplied) in County Kerry; and if he will make a statement on the matter. [1566/94]
The person named has been deemed ineligible for grants under the January-February 1993 special beef premium scheme because he applied for premium on an animal which was not in his ownership and possession on the date of application as required under the terms and conditions of the scheme. This animal had been slaughtered a few days previously. I understand that the person named was advised by my Department not to apply on this animal so there is an indication in his case of an intentional false declaration. The penalty for such a declareation under the EU regulations governing the scheme is that the applicant is ruled out of the special beef premium scheme for 1993 and 1994.

The person named has already been paid all grants due to him under the January-February 1993 22 month and June 1993 ten month special premium schemes. He was paid the first instalment of January-February 1993 special beef premium, £31.63, on 27 November 1993 and the balance £21.10, on 25 April 1994. He was paid £105.46 in respect of his full June ten month special beef premium grant on 9 June 1994. One of the three animals applied on under the June 1993 ten month special beef premium scheme was found to have been previously paid. He did not apply under any other 1993 special beef premium scheme. His applications for grants under the 1994 special beef premium schemes will be processed in due course. Under EU regulations payments under these schemes cannot be made before 1 November 1994.
