94 Mr. Bell asked the Minister for Enterprise and Employment the reason for the delay in the payment of redundancy payment to a person (details supplied) in County Louth; and when payment will be made to this person. [2449/94]

The responsibility for paying a redundancy lump sum to an employee rests with the employer in the first instance. If the employer is unable or refuses to pay, there are remedies open to employees. For a payment to be made to an employee from the Social Insurance Fund entitlement must be established either by (i) a redundancy certificate given by the employer or on his behalf, or (ii) by decision of the Employment Appeals Tribunal.

I understand that the person on whose behalf the Deputy is inquiring has received a favourable decision of the Employment Appeals Tribunal. At that point she would have been advised by the tribunal to pursue the matter with her former employer and, if she failed to obtain satisfaction within a reasonable time to refer to Form R.P. 14, which is an employee's application for a lump sum payment from the Social Insurance Fund. To date my Department has not received such an application from this person. If she has requested payment of her redundancy lump sum from her employer, as advised by the Employment Appeals Tribunal, and has not had a satisfactory response, she should apply to the redundancy payments section of my Department by completing the appropriate form R.P. 14, which my Department has now sent directly to her.
