Written Answers. - Delay in Chief State Solicitors's Office.

42 Mr. Aylward asked the Taoiseach the reason for the delay by the Chief State Solicitor's Office in replying to queries on one of a number of dealings for a person (details supplied) in County Kilkenny which was submitted to that office in September 1990. [1934/95]

The transaction in question is a sale of a parcel of land in Harristown, County Kilkenny to the Commissioners of Public Works in Ireland. The deed of transfer of the land was executed and the purchase price was paid by the Commissioners in 1986, but a succession of queries of a technical legal nature which have been raised by the Land Registry have delayed the registration in the Land Registry of the change of ownership of the lands, which involves certain supplementary provisions concerning rights of way. The latest of these queries, which concerns a problem arising from rights of way, was raised by the Land Registry in September 1990. This necessitated the obtaining by the Chief State Solicitors's Office of further instructions from the Commissioners of Public Works, and consideration of the question whether the execution of a further deed by the vendor would be required. As a result of further correspondence in 1994 and this year, it is considered that it should now be possible to satisfy the Land Registry and complete the registration, in the near future.
