Written Answers. - Negligence and Nuisance Claims.

Ceist:

95 Dr. Upton asked the Minister for Arts, Culture and the Gaeltacht in respect of claims for negligence and nuisance against his Department for each year since 1990, the total number of claims made; the total number of claims settled; the total amount of money paid in settlements; the total amount of money paid in legal costs arising from the settlements; the total number of claims outstanding at present; and the estimated cost of these claims. Since the establishment of the Department of Arts, Culture and Gaeltacht one claim was made which was settled with a third party. No award for damages or costs was made against the State.

The position with regard to claims made against the State since 1990 and before my Department was established is as follows:—

—one case was settled at a cost £5,500 plus legal costs of £750;

—a second case is still pending. No amount is mentioned but it is within the jurisdiction of the Circuit Court.

—legal costs amounting to £3,682.47 were paid in 1991 arising from a claim which was settled in 1989.
